{"id":3023,"date":"2022-03-22T13:06:00","date_gmt":"2022-03-22T11:06:00","guid":{"rendered":"https:\/\/cusens.md\/?p=3023"},"modified":"2022-03-28T13:13:25","modified_gmt":"2022-03-28T11:13:25","slug":"despre-dreptul-la-munca-a-persoanelor-cu-nevoi-speciale","status":"publish","type":"post","link":"https:\/\/cusens.md\/ro\/explicative\/despre-dreptul-la-munca-a-persoanelor-cu-nevoi-speciale\/","title":{"rendered":"Despre dreptul la munc\u0103 a persoanelor cu nevoi speciale"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<!-- VideographyWP Plugin Message: Automatic video embedding prevented by plugin options. -->\n\n<p><strong>Potrivit datelor Biroului Na\u021bional de Statistic\u0103 pentru anul 2020, \u00een Republica Moldova sunt circa 175 de mii de persoane cu dizabilit\u0103\u021bi, dintre care doar 14% au reu\u0219it s\u0103-\u0219i g\u0103seasc\u0103 un loc de munc\u0103.\u00a0Adic\u0103, doar o persoan\u0103 cu nevoi speciale din \u0219apte are un job oficial \u00een Republica Moldova. <\/strong><\/p>\n\n\n\n<p>De ce st\u0103m at\u00e2t de prost la capitolul respectarea dreptului la munc\u0103 a acestor categorii de persoane? <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>GHEORGHE BOS\u00ceI, jurist, Centrul pentru Drepturile Persoanelor cu Dizabilit\u0103\u021bi<\/strong>: <em>Legisla\u021bia Republicii Moldova este una bun\u0103 \u0219i se bazeaz\u0103 pe promovarea \u0219i protejarea drepturilor persoanelor cu dizabilit\u0103\u021bi, astfel \u00eenc\u00e2t aceste persoane s\u0103 se bucure de acelea\u0219i drepturi pe care le au to\u021bi ceilal\u021bi membri ai societ\u0103\u021bii, pentru c\u0103 dreptul la munc\u0103 a persoanelor cu dizabilit\u0103\u021bi este mai dificil dec\u00e2t pentru ceilal\u021bi membri ai societ\u0103\u021bii, determinat \u0219i de afec\u021biunea medical\u0103 pe care o are. Legislatorul ne spune c\u0103 persoanele cu dizabilit\u0103\u021bi trebuie s\u0103 fie ajutate ca s\u0103-\u0219i exercite dreptul la munc\u0103 \u00een mod egal cu ceilal\u021bi membri ai societ\u0103\u021bii.<\/em><\/p><\/blockquote>\n\n\n\n<p>Legea prevede expres c\u0103 angajatorii, care au cel pu\u021bin 20 de salaria\u021bi, ar trebui s\u0103 angajeze \u0219i persoane cu dizabilit\u0103\u021bi. Mai exact, la fiecare 20 de angaja\u021bi, unul ar trebui s\u0103 fie cu nevoi speciale. \u00cen procente, ar \u00eensemna 5% din num\u0103rul total al salaria\u021bilor s\u0103i. Cu toate acestea, nu to\u021bi respect\u0103 legea.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>GHEORGHE BOS\u00ceI, jurist, Centrul pentru Drepturile Persoanelor cu Dizabilit\u0103\u021bi<\/strong>: <em>Angajatorii au nevoie de muncitori f\u0103r\u0103 afec\u021biuni medicale \u0219i au nevoie de oameni care s\u0103 nu aib\u0103 preten\u021bii, s\u0103 nu le creeze probleme \u00eentr-un fel \u0219i au nevoie de robo\u021bei, hai s\u0103 le spunem. &#8211; \u0218i cum califica\u021bi acest aspect? &#8211; Asta este discriminare, fiindc\u0103 refuzul de a acomoda rezonabil un serviciu sau un drept, sau anumite activit\u0103\u021bi, reprezint\u0103 discriminare \u0219i discriminarea, la fiecare pas acum se aude de discriminare, ea este opusul egalit\u0103\u021bii.<\/em><\/p><\/blockquote>\n\n\n\n<p>La \u00eenceputul anului, mai exact \u00een luna ianuarie, deputa\u021bii au votat mai multe modific\u0103ri ale legisla\u021biei, care au drept scop stimularea angaj\u0103rii persoanelor cu dizabilit\u0103\u021bi.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>DAN PERCIUN, deputat, PAS<\/strong>: <em>Extinderea subven\u021biei la angajare a acestor persoane pe parcursul a \u0219ase luni de zile, de la 30% din salariul mediu pe economie, la 50% din salariul mediu pe economie. La fel, extindem interpretarea no\u021biunii de adaptare a locului de munc\u0103, \u00een a\u0219a fel \u00eenc\u00e2t s\u0103 poat\u0103 fi subven\u021bionat\u0103 nu doar achizi\u021bia echipamentului necesar pentru \u00eencadrarea acestor persoane \u00een procesul de munc\u0103, dar \u0219i amenajarea spa\u021biului. Asta \u00eenseamn\u0103, bun\u0103oar\u0103: rampe de acces, \u00eenseamn\u0103 vecee specializate \u0219i alte lucr\u0103ri care contribuie la asigurarea unui climat de munc\u0103 potrivit. Totodat\u0103, din contul subven\u021biei respective, pentru adaptarea locului de munc\u0103, va deveni posibil\u0103 angajarea unei persoane care s\u0103 faciliteze integrarea. Totodat\u0103, noi cre\u0103m un nou tip de subven\u021bie, care \u021bine de acoperirea cheltuielilor de transport.<\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>GHEORGHE BOS\u00ceI, jurist, Centrul pentru Drepturile Persoanelor cu Dizabilit\u0103\u021bi<\/strong>: <em>La moment, avem politici \u00eendreptate spre stimularea angaj\u0103rii, dar eu cred c\u0103 politicile trebuie s\u0103 fie \u00eendreptate mai mult spre schimbarea mentalit\u0103\u021bii, dar \u0219i stimularea financiar\u0103 tot are importan\u021b\u0103. Adic\u0103, \u00een momentul \u00een care tu ceri de la un angajator ca s\u0103 creeze un loc de munc\u0103 la 20 de posturi, tu trebuie s\u0103-i dai \u0219i o stimulare financiar\u0103, care nu trebuie s\u0103 fie bazat\u0103 doar pe o durat\u0103 de jum\u0103tate de an.\u00a0<\/em><\/p><\/blockquote>\n\n\n\n<p>Persoanele cu dizabilit\u0103\u021bi sunt, din p\u0103cate, deseori victimele discrimin\u0103ri. De exemplu, din cele 87 de cazuri de discriminare la locul de munc\u0103, ajunse \u00een 2020 \u00een vizorul Consiliul pentru prevenirea \u0219i eliminarea discrimin\u0103rii \u0219i asigurarea egalit\u0103\u021bii \u00een Republica Moldova, \u00een circa 16% motivul discrimin\u0103rii este dizabilitatea.
